Blackout 505 case postponed till August 4

PETALING JAYA, 5 June: The Sessions Court today fixed the mention date for the case of the Rembau PKR Branch Chief, Badrul Hisham Shaharin, to August 4, on charges of illegally organising an assembly on May 25 at the Amcorp Mall field.

The judge ruled that Bardul, or Chegubard’s trial will depend on the outcome of the case involving another PKR member, Nik Nazmi Nik Ahmad, who is facing the same charges.

On April 25, the Court of Appeal decided to cancel the charges against the Selangor Deputy Speaker, Nik Nazmi Nik Ahmad, who was charged under the Peaceful Assembly Act for failing to give the police a 10-day notice when organising the Blackout Assembly at the Kalana Jaya Stadium in May last year.

However, the prosecutors presented the case before a three-judge panel at the Federal Court to reopen the charges against Nik Nazmi, Sinar Harian reported.

“The panel of judges agreed to reopen the case and set for the re-hearing of the case to take place in July. The court’s decision against Nik Nazmi will serve as reference for the charges against Chegubard’s case,” said the lawyer representing Badrul, Eric Paulsen.

The case will be tried under Section 9 (1) of the Peaceful Assembly Act (PAA) 2012 for allegedly failing to inform the police about the assembly and the accused can be punished under Section 9 (5) of the same Act, and if found guilty, the accused can be fined up to RM10,000.
