FOMCA: Amend Act, ensure that there is a ban on electronic cigarettes

SHAH ALAM, 19 Aug: Legal action cannot be imposed on users of electronic cigarettes at non-smoking zones and selling to individuals under the age of 18 as enforced against regular smokers.

This is due to enforcement under the Tobacco Product Control Regulations 2004 according to the Food Act 1983 that can only be made against those who smoke tobacco-based cigarettes.

The Vice President of the Federation of Malaysian Consumers Associations (FOMCA), Yusof Abdul Rahman, said that the Ministry of Health is advised to immediately amend the Tobacco Product Control Regulations 2004 according to the Food Act 1983.

“The government should immediately amend the existing Act or enact a new Act that is specific to electronic cigarettes because enforcement cannot be carried out at this time.

“Not only at non-smoking zones, but the existing law cannot prevent students under 18 years of age to buy or smoke electronic cigarettes and sellers cannot be punished,” said Yusof when contacted by Selangor Kini today.

He added that the new amendment should uniform the rules that apply to regular cigarettes and electronic cigarettes.
