MACC and Attorney General To Face Contempt of Court

SHAH ALAM, 30 Mar: The Malaysian Anti-Corruption Commission (MACC) and the Malaysian Government allegedly acted in contempt of the court’s decision when they failed to publish an apology to the Selangor Chief Minister, Tan Sri Abdul Khalid Ibrahim in English-language newspapers.

This was after the Chief Commissioner, Datuk Seri Ahmad Said Hamdan failed to publish his apology in line with the agreement reached at the Kuala Lumpur High Court on March 19.

The agreement was recorded before the judge, Datuk Lau Bee Lian in Abdul Khalid’s lawsuit against Ahmad Said. The case was about a statement by the former commissioner four years ago about sacrificial cattle in the Bandar Tun Razak parliamentary constituency.

Among the terms agreed to by Ahmad Said is that he would express his apology in open court and to publish the apology on the front page of the New Straits Times and The Star within four (4) days from March 19.

However, Abdul Khalid in a statement said that Ahmad Said, the MACC and the Malaysian Government acted wildly and irresponsibly when they wilfully failed to discharge the order.

“Till today, they have yet to carry it out even though my lawyer has asked the defendant to do so.

“Ahmad Said, the MACC and the Malaysian Government out-rightly acted in contempt of court for knowingly failing to comply with and respect the court order,” he said in a statement.

On March 19, Ahmad Said openly apologised to Abdul Khalid in court and retracted his statement which was made and published on 21 February 2009 by the media.

In 2009, Ahmad Said claimed that Abdul Khalid had abused his power to donate RM110,400 for the purpose of purchasing 46 sacrificial cows in conjunction with the Eid al-Adha in Bandar Tun Razak in the same year.

Following the allegations, MACC started investigations and found no element of abuse of power or irregularities in the purchase.

Abdul Khalid stressed that this overzealous action by both defendants were intended to insult him constantly as a victim of defamatory words.

In relation to that, he instructed his lawyer, Sankara Nair to initiate a contempt of court proceeding against Ahmad Said, the MACC and the Malaysian Government.

“The actions of the defendants are in line with the Umno-BN’s attitude in undermining the Malaysian judiciary.

“They disobeyed the court order without the slightest regret because they assume that they are above the law in this country,” he said.
