PPR homeowners should pay maintenance costs, avoid legal action

SHAH ALAM, 11 Feb: The owners and tenants of the People’s Housing Programme (PPR) have been asked to cooperate in paying the cost of maintenance to avoid legal action being imposed against them.

The Exco for Housing, Building Management and Urban Living, Datuk Iskandar Abdul Samad, said that the action is in line with the introduction of a new act; the Strata Management Act 2013 (Act 757).

He said that not only owners, but tenants are also not exempted from being acted upon through it (the Act).

“There are approximately 200 cases that have been brought to court since 2013. The state government will assist the Joint Management Body (JMB) or the Management Corporation (MC) to take those who did not pay to court,” he told Selangor Kini.

However, Iskandar said that the state government does not intend to prosecute the related parties in court because usually when a notice is issued, most of them come forward to settle the payment.

He said that owners and tenants themselves will bear the impact if their payment is not settles, as prescribed.

“It is not that we want to arrest them and take them to court. Under the new Act, there is also a forum for them to discuss if they do not agree called the Strata Housing Tribunal (TPS).

“Perhaps previously it was hard for them to protest but with this tribunal, they can express their dissatisfaction and the tribunal will issue a decision just like the magistrate court. Hopefully, this tribunal will solve the problems,” he said.

Prior to this, he said that indeed problems came up, especially among the tenants who refused to pay the maintenance costs because they assume that the house they are occupying does not belong to them.

The Strata Management Act 2013 (Act 757) is a law that is provided for the regulation of maintenance and management of multi-level buildings or land that has been divided, and strata ownership was issued starting from the stage the vacant ownership is given until the stage after the management corporation is created.

Prior to this, the Chief Minister, Mohamed Azmin Ali, in a statement asked the owners and tenants of PPRs in Selangor to be more responsible and disciplined in paying their monthly maintenance costs in order to cover the expenses of repairs for the residential infrastructure.

He said that RM15 per unit is considered small and they are also responsible for contribution towards maintenance costs.
