Wrongful arrest for ‘khalwat’, JAIS should provide show-cause letter

SHAH ALAM, 5 JULY: The Selangor Islamic Religious Department (JAIS) was asked to provide a valid reason to why four individuals were caught for ‘khalwat’ while in the midst of moving houses.

Chief Minister, Tan Sri Abdul Khalid Ibrahim, said JAIS should be responsible in executing its duties and also must be according to proper procedures.

“We hope JAIS will improve as JAIS did not follow procedures for a few of its actions. The arrest is very inconvenient,” he said at a press conference after launching the Private Water Meter Migration Convention here, today.

He was asked to comment on the actions of two JAIS officials in arresting four individuals for committing the act of ‘khalwat’ when they were actually busy cleaning and in the process of moving house.

The incident happened on 22 June, where Hanisha Abdul Rahman, 29 was arrested with a driver, Muhammad Mukamil Nordin and two other workers after a five minute discussion.

During the arrest, Hanisha was found to be in the house with two other housemates while Muhammad was outside the house.
While commenting on the issue, Abdul Khalid said the state government does not have the power to advise JAIS regarding issues involving Muslims.

“Unfortunately, JAIS only informs the state government and the EXCO when there is action to be taken on non-Muslims. As for Muslims, JAIS does not require advise from the state government,” he said.

On the 1st of June, JAIS was criticized by many parties for raiding a wedding ceremony to arrest the bride, Zarinah Abdul Majid as there was a confusion regarding the status of her religion.
