PUTRAJAYA, 18 Sept: Despite being part of the meeting between Saiful Bukhari Azlan and Datuk Seri Najib Razak, Datuk Seri Shafee Abdullah remains that main prosecutor in the Sodomy II case.
The decision was unanimous by the panel of three judges of the court of appeal, Datuk Ramli Ali (head), Datuk Ruhana Yusof (replacing Datuk Tengku Maimun Tun Mat) and Mohd Zawawi Salleh.
It causes a conflict of interest between the witness and the prosecutor in the charge against the Parti Keadlian Rakyat (PKR) leader, Datuk Seri Anwar Ibrahim.
Consequently, Anwar plans to file an appeal to review the decision at the Federal Court in the near future.
“It is generally known that Datuk Shafee is the lawyer of the Prime Minister, the Government, Umno and all cases against me, and he said that he would not interfere and not be biased. But he behaves more (biased) than Umno politicians. Everyone knows this.
“He also admitted to being in the house of Datuk Najib when Saiful was present for two to four house, and he said that he did not discuss or know anything. He just had coffee?
“This has never been denied,” he said soon after the appeal proceedings set aside Shafee as the main prosecutor here at the Court of Appeal today.
He also claimed that Shafee frequently made reckless and inappropriate accusations when arguing in court.
Meanwhile, the proceedings of the Defamation II case will continue on a date yet to be determined.
On 9 Jan, 2012, the Kuala Lumpur High Court ruled that Anwar was not guilty on the charges created by Saiful Bukhari.
