PETALING JAYA, 6 May: The Sessions Court discharged the Deputy Speaker of the Selangor State Assembly (DNS), Nik Nazmi Nik Ahmad, for organising a rally on May 8, last year.
Judge Yasmin Abdul Razak made the ruling after hearing submissions of deputy public prosecutor Wan Shaharuddin Wan Ladin and Nik Nazmi’s counsel N. Surendran.
Yasmin decided that Nik Nazmi is discharged but not acquitted of the charged under the Peaceful Assembly Act 2012.
Judge Yasmin made her order on the grounds that it was premature for the prosecution to recharge the PKR lawmaker as it should have first filed an appeal first against the Court of Appeal’s decision instead of filing a new case at the Sessions Court.
Yesterday, the Attorney-General ordered for Nik Nazmi to be recharged under the PAA despite the Putrajaya Court of Appeal, on April 25, released him by declaring that the punishment under Section 9 (5) of the PAA was unconstitutional.
