Court remains with decision to release 21 individuals who participated in BERSIH assembly

SHAH ALAM, 6 June: The Shah Alam High Court rejected the appeal by the Attorney General against the decision of the Petaling Jaya Sessions Court to release 21 individuals claimed to be involved in an illegal gathering on the first anniversary of BERSIH.

Citing BERNAMA, the Judicial Commissioner Choong Siew Kim said the application by the prosecutors was baseless.

On September 18, 2012, a Sessions Court acquitted all 21 charged with taking part in an illegal assembly and ignoring the orders of police officers.

Sessions Court judge Hayatul Akmal ruled then that the prosecution had failed to prove a prima facie against the 21 who were accused of refusing to comply with a police order to disperse from a vigil held in front of the Petaling Jaya City Council (MBPJ) building on November 9, 2008, to support BERSIH.

Among those charged are the Member of Parliament for Petaling Jaya Utara, Tony Pua; Selangor State Executive Councillor, Ronnie Liu and lawyer, S Ashok Kandiah.
