Lawyer: Traffic congestion, PLUS users can file suit

SHAH ALAM, 4 July: The users of the North-South Highway Project Sdn Bhd (PLUS) have the right to file suits against the concessionaire if traffic congestion causes them to bear inconvenience and losses, in terms of physical and mental health.

The Head of the PKR Legal Bureau, Latheefa Koya, said that this is because highway users are charged a toll for using the services provided by PLUS.

“If she wants to sue, she can do so. It is not an issue. She must show how PLUS troubled her, even though she had paid the toll and so on. It is up to her because there is no hindrance to her suing.

“If we received instruction from someone suing PLUS, we have to look at what evidence can be presented by the parties involved; saying that it has cause a loss of caused suffering to them,” said Latheefa when contacted by Selangor Kini today.

She also added that in addition to filing a suit at the civil court, parties who intend to sue PLUS can also submit their suit through the Consumer Tribunal or both.

“Her wanting to sue is another matter, but we know that the issues regarding the PLUS toll concession agreement is still a secret.

“So even if she sues, whether the agreement can be issued, we have to wait and see if anyone wants to sue PLUS. This is just speculation. It is hard for me to comment further,” she said.

Prior to this, a recording emerged of a PLUS highway user releasing her anger on a PLUS hotline operator when she had to deal with traffic congestion everyday due to lane closures.

The woman who commutes daily from Malacca to Kuala Lumpur claimed that she has to leave her office between 9pm to 11pm to avoid traffic congestion, but still ended up stuck for hours in the jam.

The woman, who has children, claimed that this has caused her to reach home at 3am every day.
