Lawyer: “Abdul Khalid began suit against Bank Islam, not the other way around”

SHAH ALAM, 10 Sept: Tan Sri Abdul Khalid Ibrahim started taking legal action against Bank Islam Malaysia Berhad (BIMB), not the other way around.

This was confirmed by the Chief Minister’s lawyer, Thomas Philip, in a press statement last night.

Philip said that he had to clarify this after the Member of Parliament for Shah Alam, Khalid Samad, issued the information regarding the settlement, which should not have been disclosed.

“Tan Sri Abdul Khalid Ibrahim and not BIMB was the first to take action regarding the wrongful sale of the Guthrie shares he owned by BIMB.

“Tan Sri Abdul Khalid Ibrahim is the plaintiff while BIMB in the defendant in the case,” explained Philip.

In the middle of last month, Abdul Khalid asked Khalid Samad to meet both his lawyers, Philip and Derek Fernandez, to seek clarification on the out of court settlement on the BIMB loan.

The order was made by the Chief Minister after asked by Khalid Samad to explain the settlement which was claimed to be dubious by Abdul Khalid’s former party, PKR.

“Since early 2007, it was part of the overall plan to look at any possibility of an out of court settlement. This is not something new.

“We have given our advice on what we think are reasonable teams for the out or court settlement and the final settlement for the out of court settlement is more or less the same as we advised Khalid Ibrahim,” added Philip.

Philip added that as a lawyer, he was aware of all the terms contained in the settlement but it cannot be disclosed to the public without BIMB’s permission.
