SHAH ALAM, 7 Nov: Selangor State Executive Councillor, Nik Nazmi Nik Ahmad, said that he will sue the Attorney General in the near future for being ‘malicious’ in the assembly without notice case.
Nik Nazmi said on Twitter after the Shah Alam High Court’s decision to release him today that he will ask his lawyer to expedite the process to sue the AG.
Nik Nazmi, who was prosecuted three times by the Attorney General’s Office on the same offence, was released again today, this time by the Shah Alam High Court.
In today’s decision, Justice Datuk Abdul Halim Aman, said that he was bound by the Court of Appeal’s decision on April 25, which freed Nik Nazmi from the charge of organising an assembly without submitting a notice.
The decision by the Court of Appeal also declared that Sectionb 9 (5) of the Peaceful Assembly Act provides that Nik Nazmi’s offence was unconstitutional.
The section defines spontaneous gatherings as a crime and provides for a fine of up to RM10,000.
Nik Nazmi’s lawyer, N.Surendran, said that he hopes that no new charges will be imposed on his client, who “probably creates history as (the) person most acquitted for the same charge”.
