SHAH ALAM, 10 Apr: The High Court today reversed the decision by the Kuala Lumpur Session’s Court which previously acquitted 11 individuals that were involved in the BERSIH rally in 2007.
The PKR Vice President, Tian Chua, said this on Twitter.
He said that the court sentenced them each a RM8,000 fine.
However, today’s decision does not involve the release of Tian Chua and the PAS Deputy President, Mohamad Sabu.
This means that Mohamad Sabu and Tian Chua remain free, as reported by Malaysia Kini.
On February 27, 2013, the Kuala Lumpur Sessions Court released Mohamad Sabu and 13 others from charges of participating in an illegal demonstration during the BERSIH rally in 2007.
They were accused of participating in rallies organised by BERSIH at several places including the compound of the National Mosque, Jalan Istana Baru, Jalan Raja Laut and near the Sogo shopping complex at Jalan Tuanku Abdul Rahman, between 1 pm and 4 pm on November 10, 2007.
They were charged under Section 143 and 145 of the Penal Code on charges of choice in accordance with Section 27 (4) (a) of the Police Act 1967.
According to Section 143, if convicted, they can be sentenced to a maximum of six years in prison or fined or both.
Meanwhile, for Section 145, they can be sentenced to two years in prison or fined or both.
Meanwhile for Section 27 (4) (a), it provides a fine of RM10,000 and imprisonment not exceeding one year if convicted.
